Differences Between State and Federal Crimes
In State crimes, a State attorney is the office prosecuting alleged criminals, in the California State court system. The U.S. Attorney’s Office, however, prosecutes federal crimes in a federal court. First, these crimes are investigated by the numerous federal law enforcement agencies, usually either the FBI (Federal Bureau of Investigation), CIA (Central Intelligence Agency), DEA (Drug Enforcement Administration, Secret Service, IRS (Internal Revenue Service), or Criminal Investigation Division.
There are many differences between these federal agencies, too. For instance, the CIA is responsible for collecting intelligence—both domestically and abroad—of potential threats to national security. They are the chief agency for counterintelligence and counterterrorism. However, they are not a law enforcement organization, and do not act on crimes, or arrest people. That is the FBI’s job.
Federal Crimes in San Diego
It is difficult to categorize a crime as a “federal” versus a “state” crime. There are over 100 offenses that could be considered “federal crimes.” Generally, the most common federal crimes in San Diego are drug manufacturing and trafficking, immigration law violations, bank and social security fraud. That being said, it is important to have a knowledgeable defense attorney to help you understand your federal crimes, and which you might fall under. Taibi Law Center is here to help and ease any misunderstandings you may have.
Many of these federal crimes can be quite confusing, after all. For instance, marijuana laws are lax in California, and the growing and smoking of marijuana is legal in California (medicinally and recreationally). That being said, selling or trafficking across state lines of marijuana (or across the border into Mexico) is a federal offense. In this example, U.S. Federal law overrules California law. So, the selling, moving, or gifting of marijuana is a federal crime punishable by a minimum of one year in federal prison, and a $1,000 fine. Sentences can go up to 5 years in prison, and $250,000 in fines. These crimes put undocumented citizens at risk for deportation.
